Texas Woman Forced to Choose Between Religion, Job: DOJ Sues

The U.S. Department of Justice FILED A LAWSUIT Friday against the Texas Department of Criminal Justice (TDCJ) on behalf of former employee Franches Spears, who was forced to choose between her religious beliefs and her job. In 2019, Spears started wearing a headscarf to work, in accordance with her Ifa faith, a religion practiced by the Yoruba people of West Africa. Despite initially wearing the headscarf without issue, she was later told by a dismissive HR employee that it violated department grooming standards.

"Employers cannot require employees to forfeit their religious beliefs or improperly question the sincerity of those beliefs. This lawsuit is a reminder to all employers of their clear legal obligation to offer reasonable religious accommodations." - Assistant Attorney General Kristen Clarke

The TDCJ's policy at the time DID NOT PROHIBIT ANY FORM OF HEADWEAR. Spears was placed on unpaid leave and told to file for a religious accommodation, which she did, but was eventually fired while her request was still pending. The DOJ alleges that the TDCJ's actions were discriminatory and has demanded compensation for Spears' lost pay and suffering. The TDCJ has since changed its policies to explicitly allow religious headwear.
