Eddie Bernice Johnson Lives Foundation set up as part of agreement.
Family and attorney Les Weisbrod had threatened to sue Baylor Scott & White Rehab Hospital alleging her wounds from back surgery were neglected, leading to a fatal infection.
Johnson, a pioneering Black woman in politics, served nearly 30 years in the Texas Senate and U.S. House.
Weisbrod aims to highlight Texas' $250,000 cap on medical malpractice claims, pledging to raise the limit to $500,000.
Johnson's son found her begging for help, lying in urine and feces, with nurses nowhere to be found.
Her death certificate cites osteomyelitis of the lumbar spine as the cause of death.
