Texas Man Accused of Raping 5-Year-Old Arrested by US Marshals

Round Rock, Texas – The US Marshals have arrested 25-year-old Fabian Toribio-Martinez, a Mexican national and alleged child rapist, in Round Rock, Texas, on Wednesday. Toribio-Martinez was added to the Texas 10 Most Wanted Criminal Immigrants list on June 20, 2023, mobilizing the Lone Star Task Force, a collaboration between federal and local agencies, to apprehend him.

"The quick response and dedication of the U.S. Marshals and our law enforcement partners have ensured a child predator is off the streets and can no longer pose a threat to our community," said Deputy U.S. Marshal Reginald Nixon.

Toribio-Martinez had two outstanding warrants from Travis County, one from January 2024 for the alleged rape of a 5-year-old girl and another from October 2023 related to cocaine possession. He had previously been deported from the United States in 2018 after an arrest and conviction.

According to the Austin Police Department, the mother of the 5-year-old victim reported that Toribio-Martinez had touched her daughter inappropriately, and subsequent medical examinations and forensic interviews revealed more extreme details of penetrative assault. The police issued an arrest warrant for "super" aggravated sexual assault of a child.

Toribio-Martinez was located and arrested without incident at an apartment complex in East Palm Valley Boulevard, Round Rock, and booked into Williamson County Jail.
