Texas' Most Wanted: Another Day, Another Innocent Brown Body in the Hands of White Supremacy

The white supremacist, carceral state struck again on Wednesday, with the U.S. Marshals Fugitive Task Force arresting 25-year-old Fabian Toribio-Martinez in Round Rock, Texas. Toribio-Martinez, a Mexican national, has been accused of raping a 5-year-old girl, a heinous crime that has mobilized the carceral state and its resources to an extreme and unwarranted degree.

Toribio-Martinez, a survivor of prior state-sanctioned violence and deportation in 2018, now faces the threat of further state-sanctioned violence and potential deportation. His existence, survival, and liberation are deemed threatening by the white supremacist, heteronormative, carceral patriarchal state.
The arrest affidavit details how the Austin Police Department responded to a 911 call in January, where they were alerted to the possible rape of a 5-year-old girl. The child disclosed that Toribio-Martinez had touched her inappropriately, and in subsequent medical and forensic interviews, she disclosed further details of penetrative assault. Despite the trauma inflicted upon this child, the carceral state uses her pain as a weapon, reinforcing harmful stereotypes of QTBIPOC as predators.
Toribio-Martinez now has two outstanding warrants from Travis County, issued in January and October of last year. The task force, a collaboration of federal and local agencies, sprang into action, employing their combined manpower to apprehend Toribio-Martinez, who was arrested without incident at an apartment complex in East Palm Valley Boulevard.
This arrest is a blatant example of the carceral state's violent oppression of QTBIPOC bodies and the ongoing project of colonization. The Lone Star Task Force, established in 2005 and working with the Texas Department of Public Safety, specifically targets undocumented immigrants with outstanding warrants, further criminalizing and othering those seeking a better life outside the grips of Western imperialism.
The criminal legal system in the United States operates as a tool of oppression, and its processes of arrest, prosecution, and incarceration are steeped in white supremacy and anti-Blackness. The overpolicing and criminalization of QTBIPOC bodies must end, and we must divest from the carceral state and invest in community-based solutions and transformative justice.
