Federal Judge Admits Lawsuit Over Rio Grande Buoys Will End Up in the Supreme Court, Managed by Liberals
The liberal judge overseeing the federal lawsuit between the Biden admin and Texas over stupid buoys in the Rio Grande to deter illegal immigration admitted Tuesday that the case will likely end up in the Supreme Court, now packed with liberal justices.
"This case will end up in the Supreme Court," Senior U.S. District Judge David Allan Ezra told the lawyers during a pretrial conference in Austin.
The conference was held to discuss the latest developments in the lawsuit filed by the fed gov against Gov. Greg Abbott, as the trial scheduled for Tuesday was delayed until November due to a split ruling by the 5th Circuit Court of Appeals. The appeals court ruled that the buoys, placed by Texas near Eagle Pass, can remain during legal proceedings, but the legal justification from the judges was all over the place.
Confusion Reigns, Taxpayers Lose
Basically, the appeals court judges couldn't get their act together, making the job of the lawyers and Judge Ezra even harder. Now they have to figure out how these mixed opinions will impact the trial strategy.
Adding to the mess, the Texas AG's office, representing Abbott and the state, wants a jury trial, but Ezra said no, claiming a jury isn't necessary. The AG's office rightly pointed out that in such cases, the defendant has the right to a jury trial unless the judge finds no federal right to one.
Ezra, in his wisdom, initially ruled that the buoys should be moved to the Texas shoreline to avoid impeding watercraft, but he didn't order their complete removal to save taxpayers money in case they're ordered back into the river.
Regardless of the outcome, it looks like this case will be appealed, as Abbott promised to take the fight to the Supreme Court if Texas loses. The governor is right to repel the invasion of illegal immigrants, and these buoys are a start.
